Certified Personnel Policy Committee Minutes: June 9, 2016

Present: Chairperson Pam Fitzgiven, Loveida Ingram, Judy Stockrahm, Melissa Moore, Renee George, Paul Brewer, Dr. Jerry Guess, Attorneys Alan Roberts and Whitney Moore

Call to order: 10:23 a.m. 

TESS/LEADS:

Protocol should be entered into the policies. Guess asked if we were ready to provide it. We are. LEADS is not quite ready yet. Sam Altschul, Dr. Warren, and Pam Fitzgiven are working on it. LEADS can be added in August. TESS is the critical point right now. June 20th is when it will be brought to the CAB. 

Certified PPC Proposal: Motion to accept the collaborated TESS language to replace the language under LICENSED PERSONNEL EVALUATION (p.56-58) as proposal was made by Judy Stockrahm; seconded by L. Ingram; motion carried by way of roll call vote.

No Fault Absence Control Policy #1:

Chairperson Fitzgiven asked, “Is your intention to keep people from using their sick leave?” Dr. Guess stated it is to keep people at work. The committee believes it is a violation of the law. “Is the point system for tardiness and absences?” He stated it is a no fault policy. Dr. Guess said, “We don’t care if you have a note from a physician or not”. He stated there has been too many absences and he feels it works within the law. Chairperson asked if the attorneys present were responsible for writing the Dr. Guess’ recommendations and Alan Roberts nodded his head yes to confirm.  Chairperson Fitzgiven reminded the committee that Commissioner Key expects administration to collaborate with the PPC and the CAB. The committee agrees that we need to address the sick leave policy, but Dr. Guess’ proposal is, in our opinion a violation of the law, and the majority of wording in his absence control is more like a rationale than policy and much can be deleted. The point system should fall under “tardiness” rather than for absences. Alan Roberts asks if we are willing to meet again to discuss this later. Chairperson Fitzgiven said No. The title is punitive, as well as the language, and could be problematic just as Commissioner Key stated in his letter. 

The Certified PPC proposal was presented and reviewed with the committee and the attorneys. Insert the word “schedule” on page 2 of Tardiness #1.  His attorneys are willing to take our proposal and collaborate. The committee agreed to allow administration to collaborate and for them to send to Chairperson Fitzgiven for the committee review and make a motion and final vote via email prior to June 20.  

#2 Seniority Center:

Pam read the definition of “Seniority”. We REJECT Dr. Guess’ proposal. Motion to reject the Superintendent’s Recommendation #2 was made by M. Moore; seconded by L. Ingram; Motion carried by way of roll call vote.

#3 Resignations:

#4 and #5: Salary Schedule Policy for Administrators and Index Factors:  

P. Brewer responded to Chairperson’s request and produced documentation of administrators gaining and losing money based on the Superintendent’s proposed salary schedule. Chairperson Fitzgiven stated that she would never support a salary schedule in which any employee would lose money, much less 25 administrators. The only reason the Superintendent could state as to why administration needed to be added to the teachers’ salary schedule was that PCSSD is the only school district in the state of Arkansas that has two separate salary schedules. Chairperson Fitzgiven stated that wasn’t a good enough reason to make the change. There is no law that stipulates that administration must be part of the teachers’ salary schedule when we have been operating just fine with separate salary schedules for decades. Chairperson shared the history with the committee regarding the Professional Negotiations Agreement (PNA). Any time teachers received a percent pay increase added to the base of the salary schedule, administrators received the same percent. Chairperson Fitzgiven shared administrators’ concerns with this proposed salary schedule and stated she is willing to collaborate and take the administrators suggestion to “grandfathers in” administrators so that no one loses any money. Alan Roberts and Whitney Moore stated they were not willing to collaborate on this.

Motion to accept the Superintendent’s Recommendations #4 and #5 as a proposal was made by Dr. Guess; seconded by P. Brewer; Motion failed by way of roll call vote.
